Sharia & Islamic Justice: A Comprehensive Guide

1

The Foundation: Adl (Justice) & Ihsan (Excellence)

Quran 16:90
"Indeed, Allah orders justice and good conduct and giving to relatives and forbids immorality and bad conduct and oppression. He admonishes you that perhaps you will be reminded."

Key Distinctions:

Adl (Justice): Giving people what you owe them and taking what they owe you
Ihsan (Excellence): Giving people more than what you owe them or forgiving what they owe you
2

Economic Justice: Prohibition of Riba

Quran 2:275-279

Social Justice Issue:

Riba (usury/interest) creates unbearable debt cycles that destroy societies
Prophet Muhammad ﷺ abolished all riba, starting with his own uncle Al-Abbas
Debt leads to dishonesty, corruption, and exploitation of the poor

Historical Implementation:

When Muslims conquered Mecca, Prophet Muhammad ﷺ abolished ALL riba debts, demonstrating that economic justice begins with those closest to you, even if they are wealthy.

3

Protection of Orphans

Quran 4:2, 4:10
"And give to the orphans their properties and do not substitute the defective [of your own] for the good [of theirs]. And do not consume their properties into your own. Indeed, that is ever a great sin."

Prophet's Example:

Ibn Umar (companion) would never eat a meal without an orphan at his table
Allah warns so severely about consuming orphan wealth that companions were afraid to even take a bite from an orphan's plate

Social Impact:

Creates a society where the most vulnerable are protected and cherished, not exploited.

4

Fair Treatment of Non-Muslims

Quran 60:8
"Allah does not forbid you from those who do not fight you because of religion and do not expel you from your homes from being righteous toward them and acting justly toward them. Indeed, Allah loves those who act justly."

Historical Examples:

Umar ibn al-Khattab lifted jizya (tax) from elderly People of the Book saying: "We used your youth, we won't abuse your old age"
When Muslims retreated from conquered lands, they RETURNED the jizya they had collected because they could no longer provide protection
5

Justice Transcends Personal Feelings

Quran 5:8
"O you who have believed, be persistently standing firm for Allah, witnesses in justice, and do not let the hatred of a people prevent you from being just. Be just; that is nearer to righteousness."

Core Principle:

Justice must be applied even to enemies and those you dislike
Personal animosity cannot justify injustice
This principle creates true social cohesion
6

Prophetic Mercy in Victory

Conquest of Mecca

The Ultimate Example:

After 13 years of persecution, torture, and war, Prophet Muhammad ﷺ conquered Mecca
He had complete power over those who had killed his family members and companions
His declaration: "Go, you are free" - granting general amnesty to all

Companion's Reflection:

"If we as an Ummah treated each other the way the Prophet treated his enemies, we would be good."

7

Justice Begins at Home

Family Justice

Practical Applications:

Fair treatment between children (no favoritism)
Justice between spouses
Fair treatment of in-laws
Equal treatment of guests' children and your own

Prophetic Example:

Anas ibn Malik served the Prophet for 10 years and said: "He never yelled at me, never scolded me." This is the standard for household justice.

8

Compassion for All Creatures

Prophet's Mercy

Beyond Human Justice:

Prophet stopped an entire army because a mother bird was distressed
He listened to animals' complaints during important human endeavors
This teaches that justice and compassion extend to all creation

Modern Application:

A heart that cares about people thousands of miles away must first care about those right next to you, and this care should extend to all living beings.

9

Integrity in Leadership

Sahabah Examples

Salman al-Farsi's Governance:

Appointed governor of Persian capital after being a slave
Would pick dates from trees and sell them in marketplace like ordinary people
Rode a donkey instead of royal procession

His Declaration:

"Allah has sent us from being enslaved to other slaves to being enslaved to the Lord of all slaves, from the constriction of this world to the expanse of this world and the hereafter, from the injustice of all other ways to the justice of Islam."

10

Modern Social Justice Framework

Contemporary Application

Principles for Activism:

Work with diverse groups on specific issues while maintaining Islamic principles
Genuine care must precede political activism
Start with family justice before addressing societal injustice

Key Advice:

"If you're yelling at your parents but want to go yell at a tyrant in the street - look at the tyrant in the mirror first. Justice begins with self-accountability."

The Comprehensive Nature of Islamic Justice

Sharia and Islamic justice represent a comprehensive system that addresses every aspect of human life:

1. Divine Foundation: Justice begins with proper worship of Allah, the source of all justice.
2. Economic Equity: Prohibition of riba, protection of orphan wealth, and fair distribution.
3. Universal Application: Justice applies to Muslims and non-Muslims alike, transcending personal feelings.
4. Mercy in Power: The Prophet's example shows that true justice includes forgiveness and mercy.
5. Holistic Approach: From family relationships to international relations, from human interactions to animal welfare.

The success of early Muslim societies stemmed from their genuine implementation of these principles, not just as laws but as heartfelt convictions. Modern Muslims seeking social justice must first internalize these values in their personal and family lives before effectively advocating for them in society.
